新冠疫情下對伊朗援助是否違反美國貿易製裁政策

隨著新冠肺炎疫情的爆發,伊朗成為中國境外新冠肺炎疫情爆發的最嚴重地區之一,截至3月7日,伊朗已確診病例為4747例。針對日趨嚴重的疫情情況,伊朗駐華大使館於3月4日發出了捐贈信息,當天的捐款達到了人民幣400萬元[1]。同tong時shi,中zhong國guo的de企qi業ye和he民min間jian機ji構gou開kai展zhan了le相xiang應ying的de捐juan贈zeng活huo動dong。那na麼me這zhe些xie捐juan贈zeng是shi否fou符fu合he美mei國guo對dui於yu伊yi朗lang的de貿mao易yi製zhi裁cai呢ne?針zhen對dui此ci問wen題ti,美mei國guo財cai政zheng部bu海hai外wai資zi產chan控kong製zhi辦ban公gong室shi(The Office of Foreign Assets Control of the US Department of the Treasury, OFAC)於美國時間3月6日在官網上給出了解答。解答內容如下:

 

Q:820. I want to help with the humanitarian response to the Coronavirus Disease 2019 (COVID-19) outbreak in Iran.  What can I do to help while remaining compliant with U.S. sanctions?

問:我想對伊朗爆發的新型冠狀病毒肺炎疫情(COVID-19)提供人道主義援助。在遵守美國製裁措施的同時,我能做些什麼來提供幫助?   

 

A:There are a number of ways to provide humanitarian goods or assistance to the Iranian people in response to the COVID-19 outbreak in Iran, consistent with U.S. sanctions.

答: 針對伊朗爆發的COVID-19疫情,有很多符合美國製裁措施的向伊朗人民提供人道主義物資或援助的方式。

  

The making of humanitarian donations to recipients in Iran from the United States or by U.S. persons, including the donation of medicine intended to relieve human suffering, are generally exempt from U.S. sanctions on Iran under section 560.210(b) of the Iranian Transactions and Sanctions Regulations, 31 CFR Part 560 (ITSR), provided that such donations are not being made to the Government of Iran or other persons blocked pursuant to section 560.211 of the ITSR, or to any individual or entity listed on OFAC’s list of Specially Designated Nationals and Blocked Persons (SDN List).

美國或美國人士向伊朗境內人士提供人道主義捐助,包括捐贈旨在減輕人類痛苦的藥品,一般不受美國在《伊朗交易和製裁條例》(ITSR)第560.210(b)條和《美國聯邦法規》第31卷第560部分(ITSR)的規定下對伊朗製裁條例的影響。然而,此類捐款不應向伊朗政府或根據ITSR第560.211條被製裁的其他人士提供,或向OFAC特別指定國民和被阻止人名單(SDN名單)所列的任何個人或實體提供。 

                         

In addition, the United States maintains broad exceptions and authorizations that allow for the commercial sale and export of humanitarian goods, including medicine and medical devices, to Iran or the Government of Iran from the United States or by U.S. persons or U.S.-owned or -controlled foreign entities, subject to certain conditions.  U.S. sanctions laws provide similar allowances for sales of humanitarian goods, including medicine and medical devices, to Iran by non-U.S. persons.  These exemptions, exceptions, and authorizations generally do not apply to transactions involving persons on OFAC’s SDN List that have been designated in connection with Iran’s support for international terrorism or proliferation of weapons of mass destruction, including the Islamic Revolutionary Guard Corps (IRGC). For humanitarian transactions involving the Central Bank of Iran, which was designated as a Specially Designated Global Terrorist pursuant to Executive Order 13224 as amended, please see General License 8 issued pursuant to the Global Terrorism Sanctions Regulations (GTSR) and the ITSR, as well as OFAC Frequently Asked Questions (FAQs) 821, 822, and 823.

Furthermore, nongovernmental organizations (NGOs) are authorized under General License E to export or re-export services to or related to Iran in support of certain not-for-profit activities designed to directly benefit the Iranian people, including the provision of donated health-related services and distribution of donated articles such as medicine intended to be used to relieve human suffering, in Iran.

此外,根據E類一般許可證的授權,非政府組織(NGO)有(you)權(quan)向(xiang)伊(yi)朗(lang)或(huo)與(yu)伊(yi)朗(lang)相(xiang)關(guan)出(chu)口(kou)或(huo)轉(zhuan)出(chu)口(kou)服(fu)務(wu),以(yi)支(zhi)持(chi)特(te)定(ding)的(de)旨(zhi)在(zai)直(zhi)接(jie)造(zao)福(fu)伊(yi)朗(lang)人(ren)民(min)的(de)非(fei)營(ying)利(li)活(huo)動(dong),包(bao)括(kuo)為(wei)伊(yi)朗(lang)提(ti)供(gong)與(yu)健(jian)康(kang)有(you)關(guan)的(de)捐(juan)贈(zeng)服(fu)務(wu)和(he)分(fen)發(fa)捐(juan)贈(zeng)物(wu)品(pin),如(ru)用(yong)於(yu)減(jian)輕(qing)人(ren)類(lei)痛(tong)苦(ku)的(de)藥(yao)品(pin)。

    

Persons interested in providing humanitarian assistance to Iran related to the COVID-19 outbreak should review sections 560.210(b), 560.530, 560.532, and 560.533 and General License E of the ITSR and General License 8 issued pursuant to the GTSR and the ITSR, the guidance provided in FAQs 549, 637, 821, 822, 823, and 826, and the guidance provided in “Guidance on the Sale of Food, Agricultural Commodities, Medicine, and Medical Devices by Non-U.S. Persons to Iran” and “Clarifying Guidance on Humanitarian Assistance and Related Exports to the Iranian People.”  Other types of humanitarian activities or exports by U.S. persons may be authorized pursuant to a specific license from OFAC.

有意向伊朗提供與COVID-19爆發有關的人道主義援助的人員應查閱ITSR發布的第560.210(b)、560.530、560.532、560.533節和E類一般許可證以及根據GTSR和ITSR第8項許可證的規定,同時查閱OFAC常見問題第549、637、821、822、823和826中提供的指引以及在“關於非美國人向伊朗出售食品、農產品、藥品和醫療器械的指導意見”和“澄清關於向伊朗人民提供人道主義援助和相關出口的指導意見”中規定的內容。其他類型的人道主義活動或美國人士的出口行為,可根據OFAC發放的特別許可證進行。

  

Please note any transfers of funds in support of activities authorized by General License E must be made by the NGOs themselves, and not directly by U.S. individuals, in accordance with the conditions of General License E.

另外請注意,根據E類一般許可證的要求,任何支持E類一般許可證授權活動的資金轉移必須由非政府組織進行,而不能由美國個人直接進行。
